   In addition, you (the Purchaser) understand that the service(s) provided by the Sky Piece Productions, LLC is unique and that the Sky Piece Productions, LLC makes arrangements to provide performance(s) a substantial time before [as what=”field18″]. You understand that the Sky Piece Productions, LLC will engage performer(s) to appear on [as what=”field18″].

   If, due to illness or any other unforeseen reason, the Artist is unavailable for the scheduled performance date, a suitable substitute will be provided. If a substitute performer can not be found the Artist will refund the booking/reservation fee amount. As much advance notice as possible will be provided given the particular circumstance.

   If you (the purchaser) cancel this Agreement, then Sky Piece Productions, LLC will suffer damages because of its obligation to those performers. These damages are difficult to measure. Therefore, if You (the purchaser) cancel this contract at any time up to thirty-one (31) days before the [as what=”field18″], then Sky Piece Productions, LLC has the right to keep the booking/reservation fee as liquidated damages to compensate the Sky Piece Productions, LLC for expenses and losses which result from cancellation of Contract by You (the Purchaser).

   If you (the purchaser) cancel this Agreement, then Sky Piece Productions, LLC will suffer damages because of its obligation to those performers. These damages are difficult to measure. Therefore, if You (the purchaser) cancel this contract at any time within thirty (30) days before the [as what=”field18″], then Sky Piece Productions, LLC has the right to keep both the booking/reservation fee and the balance amount as liquidated damages to compensate the Sky Piece Productions, LLC for expenses and losses which result from cancellation of Contract by You (the Purchaser). Any unpaid balance will be by you (the Purchaser) within five (5) business days.

7. The Purchaser will provide for any and all travel arrangements necessary to get the Artist to/from each performance out of the Artist’s metropolitan area. This shall include, but not be limited to; airfare, rental car, gas, and/or taxi services. The purchaser will also provide Artist approved lodging for any overnight stay and a $30 per diem for expenses. These items will be prepaid by the Purchaser. The Purchaser will be provided a separate invoice for these charges by the Artist.
8. If the Artist has not received payment for performance as described in section 4 and 6, the performance date(s) will be released and the Purchaser will be considered in breach of contract; the requisite penalties will apply. Checks issued by the Purchaser which fail to clear will be penalized $25 plus any bank fees incurred.
9. The Purchaser understands that during and indefinitely after, the terms of this agreement either are terminated or expire, all creative collaborations and or properties, artworks, physical, personal or character likenesses/identities, photographs, recordings, promotional ideas, literature and/or website / internet images or information, whether personal or public, that pertain directly to the Artist and or the Artist’s talents, will remain the sole property of “” and any attempt to mimic, duplicate, simulate, or employ their use, after the agreement can and will be prosecuted to the fullest extent possible. This is not limited to, but includes financial reimbursements, creative compensations, and possibly incarceration – for embezzling of creative property.
10. This Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreement, understandings, negotiations, and discussions, whether oral or written. There are no warranties, representation, and/or agreements among the parties in connection with the subject matter of this Agreement, except as to specifically set forth and referenced in this agreement and the attached Riders. This Agreement shall be governed by Arizona State law; is binding and valid only when signed by the parties below, and may be modified only in writing signed by the parties. If the Artist has not received the booking/reservation fee in the amount and in the time specified in subsection 6, then the Artist thereafter at any time shall have the option to terminate this Agreement.

12. The persons signing this Agreement on behalf of Artist and Purchaser each have the authority to bind their respective principals.
